Is Power Of Attorney Required For Patent Maintenance?

No, you do NOT need a Power of Attorney (POA) for patent maintenance, that is, to pay the maintenance fees at the USPTO (37 CFR § 1.366(a)). Maintenance fees can be paid by the patentee or by any person or entities on behalf of a patentee.


You can pay the maintenance fee online. The maintenance fees are due at the third (3), the seventh (7), and the eleventh (11) years after the date of issue and each have a 6-month grace period.


Don't forget to check if there is any change in entity status every time when you pay the maintenance fees.
